A Brazilian surgeon, former president of the Brazilian Sports Orthopedics Association, received US$4.5 million from the US Securities and Exchange Commission (SEC) for reporting a corruption scheme involving companies in the sector. The SEC is the regulatory agency for the United States stock market, similar to the Brazilian Securities and Exchange Commission (CVM). It was the first time that the SEC rewarded a whistleblower who spoke about irregularities first to the reported company and then to the agency. The clause is new, and gives the whistleblower 120 days between communicating the company and the SEC. The information is from The Wall Street Journal and the FCPA Blog website.
Now, the surgeon, whose name was not disclosed, is a whistleblower , informing the authorities about illegal acts committed by companies or associations. Under American rules, these informants are usually part of companies and are paid for their complaints. The SEC started paying whistleblowers in 2012. So far, 62 people have benefited from the policy. The awards range from 10% to 30% of the fines collected from investigations arising from complaints. The surgeon's complaint involves the medical Chinese Malaysia Phone Number List equipment company Zimmer Biomet. In January 2017, the company paid US$30.5 million to resolve Department of Justice (DoJ) and SEC investigations into violations of the FCPA, the United States' foreign corruption law. They propagate minimal state intervention through an incisive reduction of regulatory state intervention and delegitimization of the labor Judiciary, because it is supposedly “paternalistic to the extreme”, uncommitted to the ultra-liberal agenda of the historical moment experienced.
